These Terms of Service ("Terms") govern your use of birthgroveportraits.com and the products and services offered by SOULRAD LLC, doing business as Birthgrove Portraits ("Birthgrove," "we," "us"). By using the site or placing an order, you agree to these Terms. Our Privacy Policy explains how we handle personal information.

1. Personalized products

Every Birthgrove portrait is made to order from the details you enter: the name, date and minute of birth, and (optionally) the birthplace. Please check these details carefully. The preview shown in our studio is a watermarked, lower-resolution version of your design; the finished file and print are made at full resolution without the watermark. Printed colors can vary slightly from what you see on screen.

If you choose "I don't know the time," we grow a placeholder preview and will contact you for the exact minute before printing. Your finished portrait will look different from the placeholder.

2. Changes, cancellations and returns

  • Changes: We hold every printed order for 6 hours before it goes to our print partner. Email hello@birthgroveportraits.com with your order number within that window to correct details at no cost. After printing begins, changes may not be possible.
  • Returns: Because each portrait is made for one child, we cannot accept returns or exchanges for change of mind.
  • Damaged or defective items: If a print arrives damaged or defective, email us a photo within 30 days of delivery and we will replace it at no cost.
  • Digital items are delivered by email and are non-refundable once delivered, except where required by law.

3. Shipping

Shipping times shown on our site are estimates. Orders shipped outside the United States may be subject to import duties and taxes (such as VAT), which are the recipient's responsibility unless stated otherwise at checkout.

4. Birthgrove Gift

  • A Birthgrove Gift is a prepaid certificate with a one-use code. It does not expire.
  • The code's value applies to one Birthgrove portrait (digital, framed or canvas). If the recipient chooses a portrait that costs more, they pay the difference; unused value is not refunded or carried over.
  • Gift codes cannot be exchanged for cash, except where required by law, and cannot be combined with other discount codes.
  • Treat the code like cash. We are not responsible for lost or stolen codes, but contact us and we will help where we can.

5. Your portrait: what you may do with it

When you buy a portrait, we grant you a personal, non-exclusive, non-transferable license to print, display and share your portrait for personal, non-commercial purposes, including posting it on social media. You may not resell your portrait, sell prints or products made from it, or use it in advertising without our written permission.

6. Our intellectual property

The Birthgrove name and logo, the site, its design and text, the portrait style, the software and methods that generate portraits and certificates, and all portraits and other output are owned by SOULRAD LLC and protected by copyright, trademark and other laws. Except for the license in section 5, no rights are granted to you.

You agree not to: (a) copy, scrape, download, modify, decompile, reverse engineer or attempt to extract the source code or algorithms of our site or software; (b) use the site, its previews or its output to create a competing product or service, or to train or develop any software or artificial intelligence model; (c) remove or alter watermarks or copyright notices; (d) use bots, scrapers or other automated means to access the site or generate previews; or (e) interfere with the site's security or operation.

7. Astronomy and traditions

Sun, moon and star positions are calculated for the minute and place you enter and are accurate to within the precision of the published methods we use. Star signs, the Chinese zodiac, life path numbers, birthstones and birth flowers are included as fun traditions for entertainment, not as predictions or advice.

8. Your information and submissions

You confirm that you have the right to provide any details you submit, including details about a child, and that they are accurate to the best of your knowledge. Do not submit information you are not entitled to share.

9. Pricing and availability

Prices, products and promotions may change at any time. We may refuse or cancel any order, including for suspected fraud or a pricing error, and will refund any payment for a canceled order.

10. Disclaimers and limitation of liability

The site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, and our total liability for any claim relating to the site or an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages. Some jurisdictions do not allow these limits, so they may not apply to you.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Brevard County, Florida, unless the law where you live requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. The version posted on this page, with its "Last updated" date, applies to orders placed after that date.
